In this paper we introduce two issues relevantly related to the cognitive phenomenology debate, which, to our minds, have not been yet properly addressed: the relation between access and phenomenal consciousness in cognition and the relation between conscious thought and inner speech. In the first case, we ask for an explanation of how we have access to thought contents, and in the second case, an explanation of why is inner speech so pervasive in our conscious thinking. We discuss the prospects (...) of explanation for both sides of the debate and argue that cognitive phenomenology defenders are in an overall advantageous position. We also propose an account of inner speech that differs from other influential explanations in some interesting respects. (shrink)

How should we characterize the nature of conscious occurrent thought? In the last few years, a rather unexplored topic has appeared in philosophy of mind: cognitive phenomenology or the phenomenal character of cognitive mental episodes. In this paper I firstly present the motivation for cognitive phenomenology views through phenomenal contrast cases, taken as a challenge for their opponents. Secondly, I explore the stance against cognitive phenomenology views proposed by Restrictivism, classifying it in two strategies, sensory restrictivism and accompanying states. On (...) the one hand, I problematize the role of attention adopted by sensory restrictivism and I present and discuss in detail an argument that defends the limitation of sensory phenomenology so as to explain the distinction between visual and cognitive mental episodes on the basis of immediate experience. On the other hand, I address accompanying states views by discussing the empirical studies of Hurlburt et al. (2006, 2008) that defend the existence of “unsymbolized thinking”. I present how they can be construed as evidence for cognitive phenomenology views and I dispel some problems that have been raised against its acceptance. I thus conclude that cognitive phenomenology views hold up well against the restrictivist positions considered. (shrink)

Phenomenal contrast arguments (PCAs) are normally employed as arguments showing that a certain mental feature contributes to (the phenomenal character of) experience, that certain contents are represented in experience and that kinds of sui generis phenomenologies such as cognitive phenomenology exist. In this paper we examine a neglected aspect of such arguments, i.e., the kind of mental episodes involved in them, and argue that this happens to be a crucial feature of the arguments. We use linguistic tools to determine the (...) lexical aspect of verbs and verb phrases – the tests for a/telicity and for duration. We then suggest that all PCAs can show is the presence of a generic achievement-like phenomenology, especially in the cognitive domain, which contrasts with the role that PCAs are given in the literature. In this paper we address the question of what determines the content of our conscious episodes of thinking, considering recent claims that phenomenal character individuates thought contents. We present one prominent way for defenders of phenomenal intentionality to develop that view and then examine ‘sensory inner speech views’, which provide an alternative way of accounting for thought-content determinacy. We argue that such views fare well with inner speech thinking but have problems accounting for unsymbolized thinking. Within this dialectic, we present (...) an account of the nature of unsymbolized thinking that accords with and can be seen as a continuation of the activity of inner speech, while offering a way of explaining thought-content determinacy in terms of linguistic structures and representations. Several theories propose that one of the core functions of inner speech (IS) is to support subjects in the completion of cognitively effortful tasks, especially those involving executive functions (EF). In this paper we focus on two populations who notoriously encounter difficulties in performing EF tasks, namely, people diagnosed with schizophrenia who experience auditory verbal hallucinations (Sz-AVH) and people within the Autism Spectrum Conditions (ASC). We focus on these two populations because they represent two different ways in which IS can (...) fail to help in EF tasks, which can be illustrative for other mental conditions. First, we review the main components of EF (Section 1). Then we explain the functions that IS is taken to perform in the domain of EF (Section 2) and review the evidence concerning problems about EF in the two populations of our study: Sz-AVH (Section 3) and ASC (Section 4). After this we further detail our account about what a properly functioning IS can do for both populations and how different IS profiles may impact EF performance: in the case of Sz-AVH, the uncontrolled and intrusive character of IS negatively affects EF performance, whereas in ASC, EF is not sufficiently supported by IS, given the tendency in this population to present a diminished use of IS (Section 5). We finally briefly discuss Attention Deficit/Hyperactivity Disorder (ADHD) and Developmental Language Disorders (DLD). (shrink)

Whereas intersectionality presents a fruitful framework for theoretical and empirical research, some of its fundamental features present great confusion. The term ‘intersectionality’ and its metaphor of the crossroads seem to reproduce what it aims to avoid: conceiving categories as separate. Despite the attempts for developing new metaphors that illustrate the mutual constitution relation among categories, gender, race or class keep being imagined as discrete units that intersect, mix or combine. Here we identify two main problems in metaphors: the lack of (...) differentiation between positions and effects and the problem of reification. We then present a new metaphor that overcomes these two problems: a basket of apples. We argue that considering social positions as the diverse properties of different apples avoids reification by considering categories as properties and not as objects themselves, and at the same time it allows us to think about the effects dimension from a plural and contextual approach. With this shift, we propose a reframing of the discussion in debates on intersectionality theory on the relation among categories, their in/separability and fragmentation. (shrink)

Grau and Pury (Review of Philosophy and Psychology, 5, 155–168, 2014) reported that people’s views about love are related to their views about reference. This surprising effect was however not replicated in Cova et al.’s (in press) replication study. In this article, we show that the replication failure is probably due to the replication’s low power and that a metaanalytic reanalysis of the result in Cova et al. suggests that the effect reported in Grau and Pury is real. (...) We then report a large, highly powered replication that successfully replicates Grau and Pury 2014. This successful replication is a case study in the challenges involved in replicating scientific work, and our article contributes to the discussion of these challenges. (shrink)

Jeff McMahan has long shown himself to be a vigorous and incisive critic of speciesism, and in his essay “Our Fellow Creatures” he has been particularly critical of speciesist arguments that draw inspiration from Wittgenstein. In this essay I consider his arguments against speciesism generally and the species-norm account of deprivation in particular. I argue that McMahan's ethical framework is more nuanced and more open to the incorporation of speciesist intuitions regarding deprivation than he himself suggests. Specifically, I argue that, (...) given his willingness to include a comparative dimension in his “Intrinsic Potential Account” he ought to recognize species as a legitimate comparison class. I also argue that a sensible speciesism can be pluralist and flexible enough to accommodate many of McMahan's arguments in defense of “moral individualist” intuitions. In this way, I hope to make the case for at least a partial reconciliation between McMahan and the “Wittgensteinian speciesists”, e.g. Cora Diamond, Stephen Mulhall, and Raimond Gaita. (shrink)

Philosophers of embodied and situated cognition have provided convincing explanations of what objects do in affective processes (e.g., in emotion regulation). They have often used the concept of 'affective affordance' to account for the affective role of objects but it is not clear how this concept relates to other concepts of affordance, in particular those used in empirical works in cognitive science. We start to fill this gap by providing a new definition of affective affordances and we suggest a possible (...) way to test this novel theoretical construct through a kinematic analysis of hand movements. In this essay, I argue that a proper understanding of the historicity of love requires an appreciation of the irreplaceability of the beloved. I do this through a consideration of ideas that were first put forward by Robert Kraut in “Love De Re” (1986). I also evaluate Amelie Rorty's criticisms of Kraut's thesis in “The Historicity of Psychological Attitudes: Love is Not Love Which Alters Not When It Alteration Finds” (1986). I argue that Rorty fundamentally misunderstands Kraut's Kripkean analogy, and (...) I go on to criticize her claim that concern over the proper object of love should be best understood as a concern over constancy. This leads me to an elaboration of the distinct senses in which love can be seen as historical. I end with a further defense of the irreplaceability of the beloved and a discussion of the relevance of recent debates over the importance of personal identity for an adequate account of the historical dimension of love. The Oxford Handbook of the Philosophy of Love offers a wide array of original essays on the nature and value of love. The editors, Christopher Grau and Aaron Smuts, have assembled an esteemed group of thinkers, including both established scholars and younger voices. The volume contains thirty-three essays addressing both issues about love as well as key philosophers who have contributed to the philosophy of love, such as Plato, Kierkegaard, Schopenhauer, and Murdoch. The topics range from central issues about (...) the nature and variety of love, the possibility of its rational justification, and whether it is an emotion, to the significance of love for law, economics, morality, and free will. The volume also contains an introduction to the subject as well as essays on love’s relation to jealousy, biotechnology, religion, knowledge, and several other topics. Robert Kraut has proposed an analogy between valuing a loved one as irreplaceable and the sort of “rigid” attachment that (according to Saul Kripke’s account) occurs with the reference of proper names. We wanted to see if individuals with Kripkean intuitions were indeed more likely to value loved ones (and other persons and things) as irreplaceable. In this empirical study, 162 participants completed an online questionnaire asking them to consider how appropriate it would be to feel the same way about (...) a perfect replica of a loved one, as well as other questions about replaceability. Participants who previously had endorsed Kripkean reference (n = 96) rated loved ones as less replaceable on two different measures than participants who had previously endorsed Descriptivist reference (n = 66, t(160)> 2.27, p <.02, eta2> .03). Additional results suggest that this difference extends to other targets as well and is at least partially dependent on sentimental attachment. (shrink)

This essay begins with a consideration of one way in which animals and persons may be valued as “irreplaceable.” Drawing on both Plato and Pascal, I consider reasons for skepticism regarding the legitimacy of this sort of attachment. While I do not offer a complete defense against such skepticism, I do show that worries here may be overblown due to the conflation of distinct metaphysical and normative concerns. I then go on to clarify what sort of value is at issue (...) in cases of irreplaceable attachment. I characterize “unique value” as the kind of value attributed to a thing when we take that thing to be (theoretically, not just practically) irreplaceable. I then consider the relationship between this sort of value and intrinsic value. After considering the positions of Gowans, Moore, Korsgaard, Frankfurt, and others, I conclude that unique value is best understood not as a variety of intrinsic value but rather as one kind of final value that is grounded in the extrinsic properties of the object. This paper offers several criticisms of the account of rightholding laid out in S. Matthew Liao’s recent paper “The Basis of Human Moral Status.” I argue that Liao’s account both does too much and too little: it grants rightholder status to those who may not deserve it, and it does not provide grounds for offering such status to those who arguably do deserve it. Given these troubling aspects of his approach, I encourage Liao to abandon his “physical basis of moral (...) agency” account of moral status and instead adopt a position closer to a traditional “speciesist” view. In his essay “The Human Prejudice” Bernard Williams presented a sophisticated defense of the moral relevance of the concept “human being”. Here I offer both an analysis of his essay and a defense of his conclusions against criticisms made by Julian Savulescu and Peter Singer. After a discussion of the structure of Williams’s argument, I focus on several complaints from Savulescu: that Williams underestimates the similarities between speciesism and racism or sexism, that Williams relies on a disputable internalism about reasons (...) to make his case, that Williams ignores the arbitrariness of species membership, and (a complaint also made by Singer) that Williams attacks a straw man in considering only negative utilitarianism when criticizing the idea of an Impartial Observer. I defend Williams against these charges and end with a brief discussion of how his alien invasion example illustrates the fundamentally different philosophical sensibility of Bernard Williams in comparison to critics like Savulescu and Singer. In this essay I argue that the film Eternal Sunshine of the Spotless Mind eloquently and powerfully suggests a controversial philosophical position: that the harm caused by voluntary memory removal cannot be entirely understood in terms of harms that are consciously experienced. I explore this possibility through a discussion of the film that includes consideration of Nagel and Nozick on unexperienced harms, Kant on duties to oneself, and Murdoch on the requirements of morality.

The sci-fi premise of the 2002 film Solaris allows director Steven Soderbergh to tell a compelling and distinctly philosophical love story. The “visitors” that appear to the characters in the film present us with a vivid thought experiment, and the film naturally prods us to dwell on the following possibility: If confronted with a duplicate (or near duplicate) of someone you love, what would your response be? What should your response be? The tension raised by such a far-fetched situation reflects (...) a tension that exists in real life: that between an attraction to qualities possessed by a person and attraction to the person in a manner that transcends such an attachment to qualities. In short, this cinematic thought-experiment challenges us to reflect on what we really attach to when we fall in love: is it the person, or is it merely the cluster of characteristics the person manifests? Which sort of attachment is appropriate? Which is philosophical defensible? The protagonist Chris Kelvin’s ambivalence at encountering this bizarre possibility is gripping because it tracks our own ambivalence about such matters. Frankly most of us don’t know just how we would react to such a situation. The thought that accepting and embracing such a “visitor” involves a violation to the original person is natural and pervasive, especially if the acceptance comes with a failure to acknowledge the distinction between the original person and the “visitor”. At the same time, a deep attraction to such a person would surely also be entirely natural and perhaps even inescapable. We, like Kelvin, are torn in different directions by this (thankfully) far-fetched possibility. One philosopher who affirms that accepting a duplicate as though it were the original is the rational thing to do is Derek Parfit. His argument for “the unimportance of identity” is both powerful and radical, and though I’ll be critical of his approach, in the final section of the paper I suggest that it does offer up the resources for an intriguing interpretation of the end of this complex and ambiguous film. In this paper, I will discuss what the first phases of the long history of the transformation of Political in the Spiritual patria consisted of and those who made the development possible. In this essay the main protagonists will be Cicero and Saint Augustine. We will see how St. Augustine could complete the transformation of Cicero's political ideal not only theoretically but practically. St. Augustine's great work can be understood to be a replica of Cicero's Republic in which the City (...) of God is made into the Dream of Scipio and the Church occupies the place of the res publica. The theologizing of the political concepts is taken from the modernization process which Schmitt defined as illegitimate politics of the process of secularization of theoretical concepts. (shrink)

The specific role of empeiria in Aristotle’s ethics has received much less attention than its role in his epistemology, despite the fact that Aristotle explicitly stresses the importance of empeiria as a requirement for the receptivity to ethical arguments and as a source for the formation of phronêsis.1 Thus, while empeiria is an integral part of all explanations that scholars give of the Aristotelian account of the acquisition of technê and epistêmê, it is usually not prominent in explanations of the (...) acquisition of phronêsis.2 The abundant mentions of empeiria in Aristotle’s ethical treatises are often eclipsed in the secondary literature... American History X (hereafter AHX) has been accused by numerous critics of a morally dangerous cinematic seduction: using stylish cinematography, editing, and sound, the film manipulates the viewer through glamorizing an immoral and hate-filled neo-nazi protagonist. In addition, there’s the disturbing fact that the film seems to accomplish this manipulation through methods commonly grouped under the category of “fascist aesthetics.” More specifically, AHX promotes its neo-nazi hero through the use of several filmic techniques made famous by Nazi propagandist Leni Riefenstahl. (...) Now most critics admit that, in the end, the film claims to denounce racism and attempts to show us the conversion of the protagonist to the path of righteousness, but they complain that nonetheless the film (perhaps unintentionally) ends up implicitly promoting the immoral worldview it rather superficially professes to reject in its final act. This charge of hypocrisy is connected to another worry: the moral conversion in the film is said to fall flat because the intellectual resources on display to support the character’s racism are not counterbalanced by equally explicit (but superior) arguments for the anti-racist position ultimately embraced by the character. In other words, just as the devil is said to get all the good lines in Milton’s Paradise Lost, in AHX the racists get all the arguments. This has been taken to be a morally problematic flaw of the film. Critics lament that Derek’s conversion seems to result not from relevant logical inferences and valid rational argumentation but from overly simplistic and arguably egoistic insights (e.g., “has anything you've done made your life better?”) combined, perhaps, with a hackneyed cliché (in prison, one of his best friends is a black person!) In this paper I’ll attempt to rebut these charges and defend the film as a powerful, and powerfully moral, work of art. I’ll be suggesting that the seductive techniques employed allow for many viewers a degree of sympathy towards the protagonist that is crucial, both for making that character’s more horrific actions especially unsettling, and also for making his eventual conversion plausible and ultimately compelling. I’ll also argue that the manner in which his conversion is presented is in fact subtler than many critics have allowed: Derek’s transformation is not artificial or implausible but is depicted as resulting from a cumulative series of emotionally powerful life events and personal engagements. It is certainly true that it is not represented in the way some would seemingly have preferred, i.e. as straightforwardly resulting from a process of gradual intellectual improvement in Derek’s reasoning on questions of race and politics. However, I’ll argue that the decidedly emotional basis of his moral evolution is both refreshingly realistic and no hindrance to accepting his conversion as rational. Finally, properly understanding the legitimacy of the emotional foundations of much moral thought will also allow us to appreciate the ways in which our initial worries about this film’s (not insignificant) ability to persuade viewers through the engagement of emotions need not, in itself, be seen as a barrier to endorsing the film as a morally praiseworthy work. Sometimes subjects have sufficient internal and external resources to retrieve information stored in memory, in particular information that carries socially charged content. Yet, they fail to do so: they forget it. These cases pose an explanatory challenge to common explanations of forgetting in cognitive science. In this paper, I take this challenge and develop a new explanation of these cases. According to this explanation, these cases are best explained as cases of norm-induced forgetting: cases in which forgetting is caused by (...) social norms in a relevant sense. These cases draw attention to the normative aspects of the mechanisms of forgetting. This is an important but neglected aspect of cases of everyday forgetting, in particular of those characterized by a social dimension. By investigating some ways in which the psychology of social norms is causally relevant in the mechanisms of retrieval failure, I begin to fill this gap. (shrink)

In our everyday interaction with the environment, we often perceive objects and spaces as opportunities to feel, maintain, enhance, and change our affective states and processes. The concept of affective affordance was coined to accommodate this aspect of ordinary perception and the many ways in which we rely on the material environment to regulate our emo- tions. One natural way to think of affective affordances in emotion regulation is to interpret them as tools for regulating felt affective states. We argue (...) that this way of conceiving of affective affordances is too restrictive. By analyzing the role of expressive properties of objects and spaces in emotion regulation, we show that our environment does not need to elicit felt affective states to regulate our emotions. Thus, we revise the concept of affective affordance to accommodate these cases. This revised concept explains more with less. Hence, it should be preferred in wide-reaching philosophical projects that aim to explain human affectivity as a situated phenomenon. (shrink)

En tercer lugar, damos cuenta de en qué consiste la denominada “superación del pragmatismo” por parte de Eugenio d’Ors y, por (...) último, señalamos las afinidades más relevantes de su pensamiento con algunas de las intuiciones más originales del pragmatismo de Charles S. This study offers a comprehensive summary and critical discussion of Alice Crary’s Beyond Moral Judgment. While generally sympathetic to her goal of defending the sort of expansive vision of the moral previously championed by Cora Diamond and Iris Murdoch, concerns are raised regarding the potential for her account to provide a satisfactory treatment of both “wide” objectivity and moral disagreement. Drawing on the work of Jonathan Lear and Jonathan Dancy, I suggest possible routes by which her position could be expanded (...) and possibly strengthened. (shrink)

The story of the Ship of Theseus is one of the most venerable conundrums in philosophy. Some philosophers consider it a genuine puzzle. Others deny that it is so. It is, therefore, an open question whether there is or there is not a puzzle in the Ship of Theseus story. So, arguably, it makes sense to test empirically whether people perceive the case as a puzzle. Recently, David Rose, Edouard Machery, Stephen Stich and forty-two other researchers from different countries have (...) undertaken that task. We argue that their tests do not provide any evidence that bears on the question as to whether the Ship of Theseus case is a genuine puzzle. In our discussion we address also what should be taken into account if one wishes to test the puzzling, or not puzzling, status of the Ship of Theseus story. (shrink)

Authors deal with theoretical and social contexts of the teaching profession as a starting point for empirical research into ethical relationships among Slovak primary and secondary school teachers. They surveyed the opinions of teachers at that level regarding their relationship with students, parents, colleagues and superiors. According to the research results, more than 80% of respondents positively rate the behaviour of teachers towards their students and parents from the viewpoint of realising ethical values, based on which they could be an (...) ethical model for their students. The level of relationships among colleagues received a less optimistic rating. They were, however, much more critical in evaluating their superiors. Only approximately 60% of the members of school management could be an ethical model for other teachers. (shrink)

This chapter describes the concept of enactive memory, which is quite new but increasingly discussed in contemporary philosophy of memory. Although the enactive approach has been used to investigate several memory sys- tems, e.g., procedural memory, episodic mem- ory, and autobiographical memory, this chapter focuses only on the enactive approach to epi- sodic memory because most of the current debate on enactive memory is about this mem- ory system. Section “Introduction” specifies what type of enactive memory is discussed in this (...) chapter. Section “The Concept of Enactive Memory” introduces the concept of enactive memory, clarifies its central theoretical com- mitments and goals, and describes how enactivists have explained episodic remember- ing. Section “The Philosophical Context of Enactive Memory” provides a brief contextu- alization of the enactive approach to memory with respect to approaches and theories with which, for one reason or another, it shares some theoretical insights, like the embodied, the extended, and the distributed approach, and the simulation theory. Section “Forgetting as a Challenge for Enactive Memory” explains why forgetting poses an important explanatory challenge to the enactive approach to memory and describes one philosophical proposal that has been developed to address this challenge. Section “Summary” provides a summary of the chapter, mentions some ongoing projects on enactive memory, and identifies some topics that advocates of the enactive approach to memory may want to investigate in the future. Imagine a sculptor who molds a lump of clay to create a statue. Hylomorphism claims that the statue and the lump of clay are two different colocated objects that have different forms, even though they share the same matter. Recently, there has been some discussion on the requirements of consistency for hylomorphist theories. In this paper, we focus on an argument presented by Maegan Fairchild, according to which a minimal version of hylomorphism is inconsistent. We argue that the argument is (...) unsound or, at best, it just points to a well-known problem for hylmorphist theories. Additionally, we explore some general consequences of this fact. (shrink)

In what ways and how far does virtue shield someone against suffering evils? In other words, how do non-moral evils affect the lives of virtuous people and to what extent can someone endure evils while staying happy? The central purpose of this chapter is to answer these questions by exploring what Aristotle has to say about the effects of evils in human well-being in general and his treatment of extreme misfortunes.

Cancer research is experiencing ‘paradigm instability’, since there are two rival theories of carcinogenesis which confront themselves, namely the somatic mutation theory and the tissue organization field theory. Despite this theoretical uncertainty, a huge quantity of data is available thanks to the improvement of genome sequencing techniques. Some authors think that the development of new statistical tools will be able to overcome the lack of a shared theoretical perspective on cancer by amalgamating as many data as possible. We think instead (...) that a deeper understanding of cancer can be achieved by means of more theoretical work, rather than by merely accumulating more data. To support our thesis, we introduce the analytic view of theory development, which rests on the concept of plausibility, and make clear in what sense plausibility and probability are distinct concepts. Then, the concept of plausibility is used to point out the ineliminable role played by the epistemic subject in the development of statistical tools and in the process of theory assessment. We then move to address a central issue in cancer research, namely the relevance of computational tools developed by bioinformaticists to detect driver mutations in the debate between the two main rival theories of carcinogenesis. Finally, we briefly extend our considerations on the role that plausibility plays in evidence amalgamation from cancer research to the more general issue of the divergences between frequentists and Bayesians in the philosophy of medicine and statistics. We argue that taking into account plausibility-based considerations can lead to clarify some epistemological shortcomings that afflict both these perspectives. (shrink)

This article describes an attributive on the basis of a novel entitled “Der Zauberberg” of the famous German writer – Thomas Mann. This is a detailed analysis of the attributive and all examples come from the novel “Der Zauberberg”. At the outset of the article are quoted different definitions. Various classifications of attributive are presented. The article answers the questions: which part of speech can be used as an attributive. Finally I wishes to highlight the case of the subordinate clause, (...) which also fulfil the role of an attributive and refer to the special form of attributive, namely to the apposition. (shrink)

In this paper I examine some of the positive epistemic and moral dimensions of anger in Plato’s dialogues. My aim is to show that while Plato is clearly aware that retaliatory anger has negative effects on people’s behavior, the strategy we find in his dialogues is not to eliminate anger altogether; instead, Plato aims to transform or rechannel destructive retaliatory anger into a different, more productive, reformative anger. I argue that this new form of anger plays a crucial positive role (...) in our intellectual and moral development. In relation to our intellectual development, anger is often part of people’s reactions to the Socratic interrogations and it often helps or hinders attempts to acknowledge one’s ignorance and become motivated to learn. For anger to play a positive role in the context of philosophical conversations, Plato suggests its transformation from being an outward-looking and reactive emotion oriented towards retaliation (refutation), into a mostly inward-looking emotion aimed at ones’ own moral and intellectual reform or self-betterment. In relation to our moral progress, anger is strategically linked both to the control of our appetites and to the virtue of courage, so anger is crucial to the psychology of the good citizen. Concretely, anger is needed both for the development of the right opposition to injustice and greed, and for the formation of an adequate sensitivity to justice. (shrink)

The International Conference "Tra rito e mito: il Carnevale nella cultura europea" was held online on the 16th and 17th of November 2020. We present twenty-two contributions coming from various fields of the Humanities and written in Italian, French, and German. This proceedings’ foreword traces back the thread that links these essays one with another, i.e., carnivalesque imagery between ritual and mythological dimensions. Moreover, this introduction provides a key to an interpretation of Carnival as a founding instance, both regenerative and (...) conservative, of the European identity. Recovering this instance today, in the midst of a pandemic, responds to the problem of its partial loss in contemporary society, in the hope to rebuild a “free and familiar contact among people”. En este artículo nos proponemos reconstruir las bases de la teoría política calviniana. Intentaremos comprender cómo define el reformador al sujeto político de su teología, donde es definido como Pueblo de Dios. A través de una Teología de la Alianza Calvino establece los términos de un contrato político en el que las instituciones humanas son queridas y establecidas por Dios. A continuación, veremos que el Estado cristiano según Calvino es la plataforma desde la que se promueve el conocimiento de la (...) Voluntad divina, a través de la predicación y la positivación de leyes conformes a la misma. Finalmente, veremos que las ideas del reformador sobre la organización y la naturaleza de la política tuvieron en Ginebra una realización evidente. Ni sus textos ni sus acciones nos permiten calificar a Calvino de constitucionalista o republicano, sino más bien de hombre de orden y defensor de la tradición del derecho divino de los reyes. Who is Pulcinella? What does his laughter have to say about the "end of time" and the end of life of Giandomenico Tiepolo? How can the end of a life make anyone laugh like Carnival’s popular mask does? This article tries to answer such questions. By unfolding the tools that come from the realm of Giorgio Agamben’s philosophy – notably the notion of "recapitulation of time" in its relation to comedy – we will trace a path which links Michail Bachtin’s (...) theories on the carnivalesque culture together with a recognition in the aesthetics of "character". In this encounter, the consistency of Pulcinella-King Carnival’s form of life will appear in the light of an “escape route”: it winks at a kind of general and anonymous beatitude, which pairs with the experience of the destitution of time. Este artículo analiza los fundamentos doctrinales del derecho penal eclesiástico calviniano, asentado teóricamente en la teología del pecado original y cuyo ejercicio toma forma en la práctica del Consistorio ginebrino. Asimismo, explora las razones de la diferencia entre derecho penal eclesial y civil. Y es que, aunque en el calvinismo la Iglesia y el Estado son titulares de un ius gladii, sólo uno de estos sistemas penales puede reivindicar el ejercicio de la pena corporal, el otro tan sólo puede reclamar (...) un castigo espiritual: en esto haremos radicar la diferencia entre derecho y disciplina. El derecho de coacción propiamente dicho pertenece en exclusiva al Estado como tal y ni el individuo ni la Iglesia pueden reclamarlos para sí. Estamos ante una aportación fundamental de la Reforma a la historia del derecho. (shrink)

Carl Schmitt suele ser considerado un crítico de la modernidad por sostener que los principales conceptos de la teoría del Estado son conceptos teológicos secularizados. En este trabajo pretendemos poner de manifiesto que la importancia que Schmitt concede a la teología es aún mayor. En efecto, la secularización se refiere a los conceptos claves de la teoría del Estado, pero la política es previa al Estado. Y para establecer sus categorías, Schmitt se sirve de la teología: el carácter conflictivo o (...) pacífico del hombre remite al pecado original; el dilema amigo/enemigo a la elección entre Dios y el diablo, etc. Exploraremos el .alcance de estas analogías, intentando mostrar el carácter inerradicablemente teológico del pensamiento de Schmitt.
